<p>Justice for Sisters (JFS) and the following civil society organisations are deeply concerned by the anti-LGBT signboards in Terengganu. Equally alarming is the statement by the Terengganu State EXCO defending the state action as an effort to incite hatred towards homosexual behaviour (read LGBTQ people), which can be categorised as ‘hate speech’ under international human rights law.</p>



<p>Similarly, the state’s action can be classified as an advocacy of discrimination and hatred. Aside from this latest incident, Terengganu has a track record of state-sanctioned discrimination against LGBTQ people. In <a href="https://www.bharian.com.my/berita/kes/2018/09/469695/sebat-pahang-bayang-ikut-langkah-terengganu">2018, two queer women</a> were caned in an open court for attempt of <em>musahaqah</em>. In <a href="https://www.freemalaysiatoday.com/category/bahasa/tempatan/2022/12/01/sihir-bomoh-pengkid-jadi-jenayah-syariah-baharu-di-terengganu">2022, amendments</a> to the syariah criminal enactment introduced <a href="https://www.freemalaysiatoday.com/category/bahasa/tempatan/2022/12/03/pindaan-jenayah-syariah-terengganu-ada-kesan-buruk-kata-kumpulan-hak-asasi">criminalisation of trans men and gender diverse people</a> and <a href="https://www.malaysiakini.com/news/646514#google_vignette">acts preparatory to <em>liwat</em></a> (anal sex or sexual relations between men). JFS has been receiving reports of arrests and harassment of LGBTQ people through the state’s multiagency <em>aurat</em> operations, raids of private events, and even at LGBTQ people’s private homes.&nbsp;</p>



<p>The government is <em>obliged</em> by international human rights law to prohibit the advocacy of hatred against LGBTQ people that constitutes incitement to discrimination, hostility, or violence.&nbsp;&nbsp;</p>



<h2 class="wp-block-heading">Incitement of hate towards homosexual behaviour = discrimination against LGBTQ people </h2>



<p>In Malaysia, non-heterosexual sexual orientations and non-cisgender gender identities are described as “LGBT lifestyle” or “LGBT behaviour”. This is not only inaccurate, but it also has harmful effects. It is important to note that sexual orientation and gender identity are core parts of a person’s identity, similar to skin colour, indigenous status, disabilities, or neurodivergence.&nbsp;</p>



<p>When non-heterosexual sexual orientations and non-cisgender gender identities are seen as a behaviour, then there is an assumption that it can be corrected, moulded or changed. This is extremely evident in the case of Malaysia, where conversion practices or SOGIE change efforts, which are referred to as “rehabilitation” or “spiritual guidance programmes”, are promoted by the Federal and state governments.&nbsp;</p>



<p>There is an urgent need to recognise and accept the fact that sexual orientations and gender identities are diverse. This human diversity is a normal occurrence in life. The lack of recognition of this fact has a harmful impact on LGBT people’s right to live safely with dignity and their ability to exercise their rights, including freedom of religion and expression.&nbsp;</p>



<h2 class="wp-block-heading">The Terengganu state government continues to violate LGBTQ people’s constitutional rights </h2>



<p>The state actions are blatantly unconstitutional, as they violate LGBTQ people’s right to live with dignity and as equal human beings without discrimination and state intrusion into their lives. All of these rights are safeguarded under Articles 5, 8 and 10 of the Federal Constitution.</p>



<p>By placing the signboards in strategic locations such as universities to target young people, the state effectively restricts LGBTQ people’s equal, safe and dignified access to education, safeguarded under Article 12 of the Constitution. A Suhakam’s study found hate speech, name-calling, and sexual violence against trans and intersex people were rampant in educational institutions across primary, secondary and tertiary education.&nbsp;</p>



<p>All of these further make the state of Terengganu unsafe for LGBTQ people, depriving them of not only safety and dignity, but also freedom of movement stipulated under Article 9 of the Constitution.&nbsp;</p>



<p>A Justice for Sisters et al upcoming nationwide study, which includes 10 LGBTQ people (5 gay men, 5 trans women) in Terengganu, found that all 10 of them experienced discrimination and violence online and offline because of their SOGIE, ranging from employment, housing, education and other forms of discrimination by various actors. 70% were subjected to multiple SOGIE change efforts or conversion practices by family members, state and other actors. Meanwhile, two of six people who pursued tertiary education or equivalent reported sexual and verbal violence in tertiary education. Of the 10, only three people shared that they have reported cases of discrimination. The rest did not.&nbsp;</p>



<p>Against this restrictive backdrop, at least two people talked about self-censorship as a coping strategy &#8211; “not do anything that could trigger possible hate from the public” and “follow whatever rules are set at the workplace or other settings”. Five others opted to isolate themselves or live on their own to avoid discrimination and violence. Of the 10 people, half wanted to migrate. While one of them had to relocate within the state of Terengganu as a result of discrimination.&nbsp;</p>



<p>The cost of discrimination on their mental health was apparent, with 60% noting that they have experienced increased mental health burden due to discrimination, and 40% sharing that they have experienced suicidal ideation. One person shared that their suicidal attempt happened after they were outed and shamed because of their sexual orientation.&nbsp;</p>



<p>Many also spoke of the causal link between state discrimination and societal discrimination. “It is challenging safety for the community, employment opportunities are inconsistent &#8211; some accept, some don’t accept at all. The laws put a lot of pressure on us, and they punish us. In terms of laws, there must be some consideration [for LGBT people] and not penalise us, open employment opportunities and welfare support for the community”. A majority of them stressed the urgent need to raise public awareness to make both the state of Terengganu and Malaysia “less hateful and more accepting”.&nbsp;</p>



<h2 class="wp-block-heading">Weaponisation of religion against LGBTQ people </h2>



<p>We are also deeply concerned about the state’s weaponisation of religion to justify its advocacy of discriminatory hatred, which explicitly includes incitement to hostility and discrimination against LGBTQ people.&nbsp;</p>



<p>UN experts have stressed that religion and public morality are often weaponised against LGBTI people, women and minorities. In <a href="https://docs.un.org/en/A/HRC/43/48">a 2020 report,</a> the Special Rapporteur on freedom of religion or belief “rejecte(d) any claim that religious beliefs can be invoked as a legitimate &#8216;justification&#8217; for violence or discrimination against women and girls or against people on the basis of their sexual orientation or gender identity.”&nbsp;</p>



<p>The<a href="https://www.ohchr.org/en/press-releases/2023/06/freedom-religion-or-belief-not-incompatible-equality-lgbt-persons-un-expert"> Independent Expert on SOGI </a>further stressed, “religion or belief systems are often deliberately placed in antagonistic positions against the human rights of LGBT persons in social and political discourse, feeding the contention that there is an inherent conflict between them.”&nbsp; It is important to recognise the growing shift from patriarchal interpretations of theology and the inclusion of LGBTIQ people across religious institutions globally.</p>



<p>The <a href="https://www.ohchr.org/sites/default/files/BeirutDeclarationonFaithforRights.pdf">Beirut Declaration on “Faith for Rights</a>” further stresses that “religious or belief convictions are one of the fundamental sources of protection for human dignity and freedoms of all individuals and communities with no distinction on any ground whatsoever.”</p>



<p>We call on Suhakam and the Minister of Higher Education to hold a dialogue with the Kuala Terengganu City Council and state EXCO to remove the signboards, given the discriminatory intent, nature and impact of the state’s action.&nbsp;</p>

<p>Justice for Sisters (JFS) and the following civil society organisations call for restraint by state actors in their response to the fashion choices of some attendees at the recent 39th <em>Anugerah Juara Lagu </em>(AJL).</p>



<p>JFS observes discriminatory comments, including calls for restrictions and legal actions against the attendees and TV3 by various state actors and members of the public. We remind Members of Parliament, state EXCOs, government agencies, and actors that their response must not further flame discrimination. State actors and agencies have a duty to discern public backlash that is rooted in discrimination and respond wisely to de-escalate discrimination.&nbsp;</p>



<p>These reactions highlight two concerning recurring trends. Firstly, a high level of moral panic surrounding the visibility of actual or perceived LGBT people. Secondly, a very rigid and binary understanding of gender, inconsistent with facts and lived experiences of everyday people.&nbsp;</p>



<p>This signals an urgent need for public awareness and education on inclusion and gender diversity, especially in a context where gender disinformation and discrimination are on the rise.&nbsp;</p>



<p>We stress that people are diverse in their gender identities and gender expressions. While this is a fact proven by evidence and lived realities, there is increasing resistance against this fact. Further, people of diverse gender identities and expressions contribute significantly to arts, culture, and the entertainment industry in Malaysia and globally.&nbsp;</p>



<p>Gender diversity does not harm others. There is no evidence of harm caused by gender diversity. In contrast, there is overwhelming evidence of the harm caused by the suppression of diverse gender expressions and gender identities. This includes increased strain on mental health, various forms of discrimination, and restrictions on self-expression, public participation, and access to opportunities, among others.&nbsp;</p>



<p>A 2021 <a href="https://www.queerlapis.com/survey-findings-impact-of-covid-19-anti-lgbt-narratives-on-lgbtq-persons-in-malaysia-out-now/">JFS survey </a>shows 56.4% of 220 LGBTQ respondents stated that anti-LGBT statements by politicians caused them increased mental health strain. 33.6% reported discrimination, with 12.7% reporting more than one form of discrimination. <a href="https://pmc.ncbi.nlm.nih.gov/articles/PMC9601328/">Another 2022 study</a> indicates that the prevalence of mental issues among the Malaysian adult LGBT population is more than double that of the general population (80.3% vs. 29.2%). This can be attributed to the increasing discrimination against LGBT people in Malaysia.&nbsp;</p>



<p>At the same time, it is important not to make assumptions about a person’s sexual orientation or gender identity based on their gender expression. Men, in general, suffer from rigid gender constructs that limit their self-expression from how they dress, to how they express their emotions, among others. In extremely rigid societies, this can result in toxic forms of masculinity and reinforcement of binary gender stereotypes and roles.&nbsp;</p>



<p>Again, we call on state actors to refrain from making discriminatory comments. Instead, they should address the root problems &#8211; discrimination against LGBT people, gender disinformation, and gender stereotypes.&nbsp;</p>

<p>Justice for Sisters (JFS) is deeply concerned about the <a href="https://www.freemalaysiatoday.com/category/nation/2025/01/07/6-books-banned-by-govt-over-prejudice-to-public-order/">banning of six books</a> under the Printing Presses and Publications Act (PPPA) by the Ministry of Home Affairs on 19 December 2024. JFS’s review found that at least four of the six books include LGBTIQ characters and themes. All four books are international publications. As a result of the ban, those who publish, own, or reproduce the books can be fined not more than RM 20,000 or be subjected to a 3-year prison sentence or both.&nbsp;</p>



<p>The ban on the four books is part of rising trends of state-sponsored LGBTQ censorship and discrimination that JFS has been observing. Specific to the PPPA, the law has been used at least 11 times to ban LGBTIQ-related publications, namely books and Pride-themed watches between 2020 and 2024. (please see the list below)&nbsp;</p>



<p>The six books were banned as they were part of the Ministry’s “control and prevent” measure to deter threats or harm. Guided by the Rukun Negara principles of “<em>Kesopanan dan Kesusilaan</em>”, they note that the Ministry has a duty to use the PPPA to uphold public safety and order as well as prevent the spread of ideology or movement inconsistent with Malaysia’s diverse cultural and societal values.&nbsp;</p>



<p>We are deeply concerned about the Ministry of Home Affairs’ mischaracterisation, bias, and disinformation against LGBTIQ and gender-diverse people, as well as their ongoing misuse of public morality and public order.&nbsp;</p>



<p>The judges in <a href="https://globalfreedomofexpression.columbia.edu/cases/navtej-singh-johar-v-union-india/">India’s 377 case</a> noted that&nbsp; “constitutional morality would prevail over social morality” [p. 79, para. 121]. Meaning, that the provisions that safeguard the rights of the people in the Constitution (in the context of Malaysia Articles 5 to 13), must always be upheld including for LGBTIQ people regardless of whether such rights have the approval of a majoritarian government. Governments must always be guided by principles of equality, non-discrimination, personal liberties, and dignity enshrined in their Constitution.&nbsp;</p>



<p>The Ministry’s misplaced understanding of its state duties, and continued protectionist role in regulating the people’s access to information and lived experiences are equally concerning. The censorship of these publications further suppresses access to information and lived experiences of LGBTIQ and gender-diverse people essential for the promotion of understanding, self-discovery, intellectual growth, and inclusion. The continued censorship of LGBTIQ-affirming information has a lasting impact and affects LGBTIQ people and everyone in society. It continues to foster hostility against LGBTIQ people and diminishes Malaysia’s diversity.&nbsp;</p>

<h2 class="wp-block-heading">LGBTIQ people are part of human diversity; SOGIESC diversity is not an ideology </h2>



<p>We call on the Ministry of Home Affairs to stop characterising LGBTIQ people as a form of ideology. LGBTIQ people or diversity in sexual orientation, gender identity, gender expression, and sex characteristics (SOGIESC) are part of human diversity, which has been historically, medically, scientifically, and anthropologically acknowledged and documented. For example, in the 1970s, the <a href="https://www.queerlapis.com/pumpang-pumpang-episode-1-kembali-ke-pangkal-jalan-is-the-pressure-to-change-real/">American Psychological Association (APA)</a> removed homosexuality from the Diagnostic Statistical Manual (DSM) as it found that “heterosexual behaviour and homosexual behaviour are normal aspects of human sexuality.” Similarly, the <a href="https://www.who.int/standards/classifications/frequently-asked-questions/gender-incongruence-and-transgender-health-in-the-icd">World Health Organisation (WHO)</a> also noted that “evidence is now clear that it (being trans) is not a mental disorder, and indeed classifying it in this can cause enormous stigma for people who are transgender.”</p>



<p>As a criminalised, discriminated, and marginalised population, LGBTIQ people have the right to seek equality and non-discrimination through public advocacy. This human rights advocacy for equality and non-discrimination cannot be mischaracterised as a “spread of an ideology”. The existing legal discriminatory framework and lack of protection for LGBTIQ people already make them vulnerable to any form of public participation. This is evidenced by the adverse and even extreme reactions to LGBTQ visibility and inclusion in public rallies and events, among others, which in turn is resulting in self-censorship among LGBTIQ people in Malaysia.&nbsp;</p>



<p>The state’s duty to uphold human rights is clearly outlined in international human rights laws, Malaysia’s treaty body obligations, and its own Federal Constitution.&nbsp;</p>



<p>The <a href="https://documents-dds-ny.un.org/doc/UNDOC/GEN/G14/071/50/PDF/G1407150.pdf?OpenElement">UN Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression</a> has stressed that the state has a duty ‘to ensure an environment in which a diverse range of political opinions and ideas can be freely and openly expressed and debated’.</p>



<p>In Malaysia’s 2024 CEDAW review, the <a href="https://documents.un.org/doc/undoc/gen/n24/159/18/pdf/n2415918.pdf">Committee, among others, recommended Malaysia</a> to,&nbsp; “develop and implement a comprehensive strategy to eliminate stereotypes concerning lesbian, bisexual, transgender and intersex women, including by addressing discriminatory narratives targeting lesbian, bisexual, transgender and intersex women and …&nbsp; and raising awareness about the equal rights of lesbian, bisexual, transgender and intersex women.”</p>



<p>Meanwhile, the<a href="https://www.ohchr.org/en/special-procedures/sr-human-rights-defenders/declaration-human-rights-defenders"> Declaration on Human Rights Defenders</a> notes that the state has a duty to promote, protect, and implement all human rights and protect those who engage in human rights advocacy in its diverse forms.&nbsp;</p>



<h2 class="wp-block-heading">Repeal the PPPA </h2>



<p>JFS reiterates the ongoing <a href="https://www.article19.org/resources/malaysia-repeal-the-printing-presses-and-publication-act/">call by civil society groups in Malaysia to repeal the PPPA</a>, particularly Section 7. Section 7 (1) gives the Minister of Home Affairs ‘absolute discretion’ to ban any undesirable publication that is ‘in any manner prejudicial to or likely to be prejudicial to public order, morality, security, or which is likely to alarm public opinion, or which is or is likely to be contrary to any law or is otherwise prejudicial to or is likely to be prejudicial to the public interest or national interest’.&nbsp;</p>



<p>The PPPA is inconsistent with international human rights standards on freedom of expression, which require states to adhere to the three-part test when restricting freedom of expression &#8211; (i) the restriction must be provided for in law; (ii) it must pursue a legitimate aim; and (iii) it must be necessary and proportionate.&nbsp;</p>



<p>The Ministry of Home Affairs must adopt a human rights approach and immediately repeal the PPPA to end its repeated enforcement and adverse harm to society, including LGBTIQ people.</p>

Additionally, the Coordinator will undergo mentorship with Asylum Access Malaysia (AAM) to build advocacy capacity and ensure a stronger SOGIESC (Sexual Orientation, Gender Identity and Expression, and Sex Characteristics) intersection within refugee advocacy efforts.</p>

<p><br>JFS is seeking to hire a talented and experienced writer to develop a comprehensive report on the censorship of LGBT publications and items under Section 7(1) of the Printing Presses and Publications Act 1984 (Amended 2012) (PPPA) in Malaysia. This study aims to document the trends, analyse legal challenges, and provide recommendations for promoting and protecting the freedom of expression for<br>LGBTIQ and gender-diverse persons.</p>



<p><br>The role reports to the Executive Director, and includes a remuneration of <strong>MYR6,000</strong> for the chapters.</p>

<p>Justice for Sisters (JFS) is deeply concerned by the misgendering, use of discriminatory terms to describe transgender women, violation of their privacy, and other discriminatory practices related to transgender news reporting by Bernama, Malaysia’s national news agency.&nbsp;&nbsp;</p>



<p>In July alone, Bernama reported <a href="https://www.bernama.com/bm/news.php?id=2318237">two</a> transgender women-related <a href="https://www.bernama.com/bm/news.php/news.php?id=2314479">news</a> stories in English and BM. In both reports, Bernama used discriminatory terms such as <em>‘pondan’</em> and misgendered the women by using terms such as <em>‘lelaki berperwatakan perempuan’</em>, ‘transvestite’, and ‘male persons’. Additionally, both reports also disclosed their name according to legal documents, violating their privacy.&nbsp;</p>



<p>As the source for most Malaysian news media, Bernama’s poor media standards have a ripple effect on the reporting by other media outlets, who generally already have poor LGBTIQ reporting standards. Both reports were republished without correction in at least 13 media outlets in English (3) and Malay (10) languages, amplifying stigma and discrimination against transgender women.&nbsp;</p>



<p>We stress that transgender women are women. Misgendering and deadnaming trans people deny their right to identity, self-determination, equality, non-discrimination, and privacy. While the Malaysian government maintains discriminatory legal barriers for transgender people and has yet to legally recognize transgender people’s gender identity, the media must refrain from reproducing discrimination against transgender people. Instead, given the pervasive transphobia and denial of trans people’s identity, the media has an important role in educating the public on, among others, the right and respectful terms to describe trans people.&nbsp;&nbsp;</p>



<p><a href="https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6165713/">Research</a> <a href="https://www.health.state.mn.us/communities/suicide/documents/pronounssuicideprev.pdf">shows </a>that the use of the correct pronouns, names, and gender identities to describe trans and gender-diverse people can save lives, increase trust, promote well-being, and prevent mental health issues, such as depression and suicidal ideation, among others.&nbsp;</p>



<p>A <a href="https://www.ncbi.nlm.nih.gov/pmc/articles/PMC9601328/">2022</a> research with LGBTQ people in Malaysia indicated that mental health issues (including depression and suicidal ideation) are two times higher among the LGBTQ population than the general population.&nbsp;</p>



<p>A <a href="https://www.queerlapis.com/wp-content/uploads/2021/12/311221-Survey-findings_Impact-of-Covid-19-and-anti-LGBT-narratives-on-LGBT-persons-in-Malaysia.pdf">2021</a> survey showed that the media played a significant role in intensifying hostility and discrimination against LGBTIQ people. 55% of the 220 LGBTQ survey participants noted that they experienced increased strain on their mental health due to media sensationalism. Meanwhile, 59% reported experiencing one or more forms of discrimination&nbsp;</p>



<p>As the national news agency, Bernama must hold itself to higher standards and ethics, including <a href="https://www.ifj.org/who/rules-and-policy/global-charter-of-ethics-for-journalists">respecting the dignity of the persons named and/or represented</a> in its reports. All media outlets have a duty to uphold the dignity of transgender and all LGBTIQ and gender-diverse people.&nbsp;</p>



<p><strong>Trans-affirming language&nbsp;</strong></p>



<p>When reporting on stories involving transgender people, it is important to avoid terms that are pejorative, discriminatory, and outdated terms.&nbsp;</p>

<h1 class="wp-block-heading">Keperluan segera untuk Meningkatkan Piawaian Pelaporan Bernama berkenaan individu  transgender</h1>



<p>Justice for Sisters (JFS) mengambil perhatian mendalam tentang isu misgendering, penggunaan istilah diskriminatif untuk menggambarkan wanita transgender, pelanggaran privasi, dan amalan diskriminasi lain berkaitan pelaporan berita transgender oleh Bernama, agensi berita nasional Malaysia.</p>



<p>Dalam bulan Julai sahaja, Bernama melaporkan dua berita berkaitan wanita transgender dalam bahasa Inggeris dan BM. Dalam kedua-dua laporan tersebut, Bernama menggunakan</p>



<ul class="wp-block-list">
<li>istilah pejoratif seperti ‘pondan’ dan </li>



<li>kata ganti nama gender yang salah (misgendering) wanita tersebut dengan menggunakan istilah seperti ‘lelaki berperwatakan perempuan’, ‘transvestite’, and ‘male persons’. </li>

<p>Sebagai sumber utama bagi kebanyakan berita media di Malaysia, standard media yang lemah oleh Bernama memberikan kesan berganda kepada pelaporan oleh media lain, yang secara umumnya sudah mempunyai standard pelaporan LGBTIQ yang lemah.</p>



<p>Kedua-dua laporan tersebut diterbitkan semula tanpa pembetulan di sekurang-kurangnya 10 media berbahasa Melayu dan 3 media berbahasa Inggeris, dimana ianya mengulangi stigma dan diskriminasi terhadap wanita transgender.</p>



<p>Justice for Sisters menegaskan bahawa wanita transgender adalah wanita. Penggunaan kata ganti nama gender yang salah (misgendering) dan nama berdasarkan dokumen rasmi individu trans menafikan hak mereka kepada identiti, penentuan nasib sendiri, kesaksamaan, tidak didiskriminasi, serta privasi.</p>



<p>Walaupun kerajaan Malaysia masih mengekalkan undang-undang yang bersifat diskriminatif bagi golongan transgender dan masih belum mengiktiraf identiti gender golongan transgender, pihak media mestilah mengelak daripada mengulang diskriminasi terhadap golongan transgender.</p>



<p>Sebaliknya, memandangkan keseriusan penularan transfobia dan penafian terhadap identiti golongan trans di Malaysia, media berperanan penting dalam, atara lain, mendidik masyarakat berkenaan penggunaan istilah yang tepat dan terhormat bagi golongan trans.</p>



<p>Penyelidikan menunjukkan bahawa penggunaan kata ganti nama, nama, dan identiti gender yang tepat bagi golongan trans dan pelbagai gender lain membantu dalam menyelamatkan nyawa, meningkatkan kepercayaan, mempromosikan kesejahteraan, dan mencegah isu kesihatan mental, seperti kemurungan dan idea bunuh diri, serta lain-lain.</p>



<p>Penyelidikan pada tahun 2022 mengenai golongan LGBTQ di Malaysia menunjukkan bahawa isu kesihatan mental (termasuk kemurungan dan idea bunuh diri) adalah dua kali ganda lebih tinggi dalam kalangan populasi LGBTQ berbanding dengan populasi umum.</p>



<p>Kajian pada tahun 2021 menunjukkan bahawa media memainkan peranan penting dalam meningkatkan permusuhan dan diskriminasi terhadap golongan LGBTIQ. Sebanyak 55% daripada 220 peserta kajian LGBTQ melaporkan bahawa mereka mengalami peningkatan tekanan mental akibat sensasi media. Sementara itu, 59% melaporkan mengalami satu atau lebih bentuk diskriminasi.</p>



<p>Sebagai agensi berita nasional, Bernama mestilah mematuhi standard dan etika&nbsp; tertinggi, termasuklah menghormati maruah seseorang yang dinamakan dan/atau digambarkan dalam laporan mereka. Semua saluran media mempunyai tanggungjawab untuk menjaga maruah golongan transgender serta semua golongan LGBTIQ dan pelbagai gender.</p>

<p>On 4 July 2024, the Federal Court sentenced a man who was convicted of murder of a trans woman in 2009. As Malaysia has committed to abolishing the death penalty, his sentence was reduced to 38 years in jail.&nbsp;</p>



<p>The media has consistently covered the trial. However, the coverage has been consistently poor. <a href="https://eprints.kehakiman.gov.my/44401/">https://eprints.kehakiman.gov.my/44401/</a></p>



<p>Bernama’s reporting of the news in English Malay language (BM) served as the source for many media outlets. In both reports, Bernama repeatedly misgendered the late trans woman, and used stigmatising language to describe her gender identity and her occupation as a sex worker, among others.&nbsp;</p>

<p><em>A discrepancy was found in the original Bernama reports on the perpetrators’ prison sentence by the Federal Court. The BM version reported 35, while the English reported 38 years.&nbsp;</em></p>



<p>Eight media outlets republished the Bernama news. Only one media changed the discriminatory language used in the Bernama report, while the rest maintained the article as is. Two outlets, Suara Sarawak and Harian Metro used sensationalist titles. Particularly concerning is the headline by Harian Metro, which departed from its usual reporting styles related to murder and homicide that typically describe such cases as kes <em>bunuh</em> or <em>pembunuhan</em>. The headline reads as <em>bunuh</em> followed by a derogatory term used against trans women and gay men. The omission of <em>kes</em> and the use of <em>bunuh</em> over <em>pembunuhan </em>in its headline is negligent at best, and violent at worst. It can be easily misconstrued as endorsing violence against trans women.&nbsp;&nbsp;</p>



<p>Justice for Sisters identified the following harmful practices by the media in reporting the news:</p>

<p>Out of the 8 media outlets that republished the Bernama article, only one media outlet (Selangor Journal) corrected pronouns and used she/her when referring to the late trans woman. Using incorrect pronouns for trans women denies their rights to self-determination, dignity, and identity.&nbsp;</p>



<p>The correct pronouns in this context would have been she/her as she identified as a woman.</p>

<p>All articles disclosed the trans woman’s name according to her legal documents in their reports, violating her privacy and dignity. It is important to treat trans people’s names, gender markers, and other gendered information in their legal documents (identification cards or birth certificates) as sensitive information, as the leakage or non-consensual disclosure of such information can result in discrimination.&nbsp;&nbsp;</p>

<li><strong>Use of Derogatory terms or Discriminatory Language related to gender identity and sex work</strong></li>
</ol>



<p>The media outlets used discriminatory language to describe the late trans woman’s gender identity and occupation as a sex worker. The language that we use can reproduce and reinforce stigma, discrimination, and violence against groups that are already marginalised. The use of respectful and affirming language is critical when discussing all persons particularly so when it involves marginalised groups.</p>



<p style="font-size:17px"><em><strong>Discriminatory language related to gender identity&nbsp;</strong></em></p>



<p>All media reports, except one, reproduced the derogatory terms used in Bernama’s reports. Bernama used the following terminologies;&nbsp;</p>

<p>Transwoman is grammatically incorrect. <em>Trans</em> or <em>transgender </em>is used as an adjective to describe a person’s gender identity. The same rule applies to use of other adjectives to describe gender identity like cisgender (i.e ‘cisgender&nbsp; woman’ not ‘cisgenderwoman’)</p>



<p style="font-size:17px"><em><strong>Discriminatory language related to sex work</strong></em></p>



<p>The discriminatory terms used related to sex work were:&nbsp;</p>



<ol class="wp-block-list">
<li>Pelacur&nbsp;</li>



<li>Prostitution&nbsp;</li>
</ol>



<p>No outlets corrected the language used surrounding sex work.</p>



<p>Sex workers already face a high degree of violence owing to the criminalization and stigma surrounding their work. Terms such as ‘prostitution’ and ‘pelacur’ reinforce stereotypes, <a href="https://www.opensocietyfoundations.org/explainers/understanding-sex-work-open-society#:~:text=Why%20use%20the%20term%20%E2%80%9Csex,connotations%20of%20criminality%20and%20immorality.">immorality, and criminality</a> surrounding sex work. It obscures the fact that sex work is a form of work and that sex workers provide a service. As service providers and workers, they have the right to safe working environments and conditions, including being free from violence by the state and non-state actors.&nbsp;</p>

<p><strong>4. Sensational and trauma-triggering headlines&nbsp;</strong></p>



<p>Most media outlets adopted a variation of the Bernama headlines. Only one media outlet changed ‘transvestite’ to trans woman its headline. Unlike the English article, the BM Bernama article did not mention the victim’s gender identity in its headline.&nbsp;</p>

<p>The Malay language media, including Harian Metro, typically uses <em>kes bunuh</em> or <em>pembunuhan</em> in its reports and headlines about murder or homicide. However, in this report, Harian Metro’s headline used <em>‘bunuh’ </em>followed by a derogatory term to describe the victim’s gender identity and people belonging to the same group as the victim, departing from its usual style of reporting.&nbsp;</p>



<p>Against the backdrop of normalised violence against trans women and LGBTQ people, the headline not only risks being misconstrued as endorsing violence against trans women, but it also risks triggering trauma and fear among transgender women and LGBTIQ as a whole because of its violent undertone</p>



<p>Media outlets should avoid violent and trauma-triggering language.&nbsp;&nbsp;</p>



<p><strong>5. Reporting of violence&nbsp;</strong></p>



<p>The woman was kidnapped and sexually assaulted by the perpetrator and others before she was murdered according to reports. While Bernama used ‘paksa’ or ‘force’ to convey the kidnapping and sexual assault, the choices of words and language to describe the events should reflect the severity of the violence that she experienced.&nbsp;</p>

<p>Given that trans women and sex workers face increased vulnerability to sexual violence with impunity, it is important to highlight the context behind this crime. It is also important to demystify the assumption that sex workers do not or may not face sexual violence because they are sex workers. Sex workers provide consensual sexual services. They are at high risk of sexual violence and other forms of violence because of the criminalization of sex work. JFS documentation of trans women-related murder cases in Malaysia shows that a majority of them are sex workers and the perpetrators are clients of sex workers.&nbsp;&nbsp;</p>



<h2 class="wp-block-heading">Good practices&nbsp;</h2>



<p>These are some tips on reporting crimes and violence against trans, LGBTIQ and gender diverse people, and other marginalised groups.&nbsp;</p>



<ul class="wp-block-list">
<li>Provide context and present the facts as they are</li>



<li>Draw attention to the violence to spread awareness but do not sensationalise it.&nbsp;</li>



<li>Avoid victim blaming particularly in cases of sexual violence&nbsp;</li>



<li>Protect the privacy and dignity of LGBTIQ and gender-diverse people by using their self-determined names and pronouns. If unsure, use gender-neutral language (e.g. the person, the survivor, the victim, the individual) or pronouns (e.g. they/them).</li>



<li>In cases of homicide or sexual violence, consider whether naming the victim/survivor is necessary at all. Always seek the victim or survivor’s consent when naming them in a news report&nbsp;&nbsp;</li>



<li>Avoid language that stigmatizes issues such as sex work, substance use, and mental health issues&nbsp;</li>



<li>Provide contacts of support groups. Crimes against trans women, especially when they are unresolved and inadequately addressed, can create concerns over personal safety and collective trauma among the broader trans women and LGBTIQ population</li>



<li>Center the victims or survivors, instead of the perpetrators when reporting stories about homicide and sexual assault.&nbsp;</li>



<li>Consider follow-up or in-depth pieces unpacking trends and issues surrounding crime or violence as well as the impact and human costs of such violence (see below)</li>
</ul>



<p><strong>Good Practices: Follow Up Pieces</strong></p>



<p>Follow-up pieces following a crime involving trans women are important. These pieces can feature family members and loved ones, activists, and communities.&nbsp;</p>
